Article 2. Principles of foreign economic activity
Subjects of economic activity Ukraine but the foreign subjects of economic activity during realization of foreign economic activity follow such principles:
By principle of sovereignty of people of Ukraine in realization of foreign economic activity which consists in:
- absolute title of people of Ukraine independently and independently to carry out foreign economic activity on territory Ukraine, following laws which operate on territory Ukraine
- to the duty Ukraine steadily to execute all agreements and obligations Ukraine in industry of international economic relations
By principle of freedom of external economic enterprise which consists in:
- right subjects of foreign economic activity voluntarily to enter into external economic copulas
- right to carry out the subjects of foreign economic activity it in any forms which straight is not forbidden laws in force Ukraine
- to the duty to restrain during realization of foreign economic activity a order, set laws Ukraine
- absolute title of propert of subjects of foreign economic activity on all the results of foreign economic activity are got by them
By principle of legal equality and undiscrimination which consists in:
- to equality before the law of all subjects of foreign economic activity, regardless of patterns of ownership, in a that number the states, during realization of foreign economic activity
- to prohibition any, except for foreseen this Law, actions of the state, the result of which is limitation of rights discrimination of subjects of foreign economic activity, and also foreign subjects of economic activity, after the patterns of ownership, mestome of location and other signs
- impermissibilities of restrictive activity from the side of any its subjects, except for cases, foreseen this Law
By principle of supremacy of law which consists in:
- adjusting of foreign economic activity only by laws Ukraine
- to prohibition of application of підзаконних acts and acts of management of local organs, that in any method create for the subjects of foreign economic activity terms less favourable, than those which are set laws Ukrain
By principle of defence of interests of subjects of foreign economic activity, which consists in that Ukraine as the state:
- provides even defence of interests of all subjects of foreign economic activity and foreign subjects of economic activity on its territory in obedience to laws Ukraine
- carries out even defence of all subjects of foreign economic activity Ukraine outside Ukraine in obedience to the norms of international law
- carries out defence of state interests Ukraine both on its territory and after its limits only in accordance with laws Ukraine, terms of the international agreements and norms of international law signed by it
By principle of equivalence of exchange, impermissibility of dumping, at a import and export of commodities. |
